1. Introduction

Welcome to Dispak.

Dispak (“us”, “we”, or “our”) operates www.dispak.co.za (hereinafter referred to as “Service”).

Our Privacy Policy governs your visit to www.dispak.co.za, and explains how we collect, safeguard and disclose information that results from your use of our Service.

At Dispak (and including this website, www.dispak.co.za) we are committed to protecting your privacy and to ensure that your personal information is collected and used properly, lawfully and transparently.

We use your data to provide and improve Service. By using Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, the terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

Our Terms and Conditions (“Terms”) govern all use of our Service and together with the Privacy Policy constitutes your agreement with us (“agreement”).

2. Definitions

SERVICE means the www.dispak.co.za website operated by Dispak.

PERSONAL DATA means data about an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person, including, but not limited to (or from those and other information either in our possession or likely to come into our possession).

POPIA means the Protection of Personal Information Act 4 of 2013

TRAFFIC data means any data processed for the purpose of the conveyance of a communication on an electronic communications network in respect of that communication and includes data relating to the routing, duration or time of a communication

USAGE DATA is data collected automatically either generated by the use of Service or from Service infrastructure itself (for example, the duration of a page visit).

COOKIES means A small text file (up to 4KB) created by a website that is stored in the user’s computer either temporarily for that session only or permanently on the hard disk (persistent cookie). Cookies provide a way for the website to recognize you and keep track of your preferences

IP ADDRESS means a unique address that identifies a device on the Internet or a local network

WEB BROWSER means an application used to access and view this website. Well know web browsers include but not limited to Internet Explorer, Google Chrome and Safari.

DATA CONTROLLER means a natural or legal person who (either alone or jointly or in common with other persons) determines the purposes for which and the manner in which any personal data are, or are to be, processed. For the purpose of this Privacy Policy, we are a Data Controller of your data.

DATA PROCESSORS (OR SERVICE PROVIDERS) mean any natural or legal person who processes the data on behalf of the Data Controller. We may use the services of various Service Providers in order to process your data more effectively.

DATA SUBJECT is any living individual who is the subject of Personal Data.

THE USER means a person who uses a computer or other device to access this website. The User corresponds to the Data Subject, who is the subject of Personal Data.

3. Information Collection and Use

We collect and process your personal information mainly to contact you for the purposes of understanding your requirements, and delivering services accordingly.  For this purpose, we will collect contact details including your name and organisation.

We collect information directly from you where you provide us with your personal details.  Where possible, we will inform you what information you are required to provide to us and what information is optional.

Website usage information may be collected using “cookies” which allows us to collect standard internet visitor usage information.

4. Types of Data Collected

Personal Data

Dispak does not collect personal information on this site unless you provide us with your personal information. If you provide personal information through this site, it will be held by the Information Officer.

There are places on the site where you can provide personal information, such as:

  • emailing an enquiry
  • registering for an account
  • purchasing products
  • Lodge a complaint, comment or give feedback through the website
  • making a submission on a form

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”). Personally, identifiable information may include, but is not limited to:

  4. Address, Province, Postal code, City

This Usage Data may include information such as your computer’s Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access Service with a device, this Usage Data may include information such as the type of device you use, your device unique ID, the IP address of your device, your device operating system, the type of Internet browser you use, unique device identifiers and other diagnostic data.

We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide features of our Service, to improve and customize our Service.

You can enable or disable location services when you use our Service at any time by way of your device settings.

We use cookies and similar tracking technologies to track the activity on our Service to track and analyse website usage.

Links to social networking services

We use social networking services (Instagram, LinkedIn and Facebook) and network sharing services (Google Drive, Dropbox and OneDrive) to communicate with the public about its work. When you communicate with Dispak through these services, that social networking service may collect your personal information for its own purposes.

These services may track your use of our website on those pages where their links are displayed. If you are logged in to those services (including any Google service) while using our website, their tracking will be associated with your profile with those service providers.

These services have their own privacy policies which are independent of the privacy policy and practices of Dispak.

5. Use of Data

Dispak will only use personal information that you provide through this website for the purposes for which you provided it.

We will not make your personal information available to any third party unless this is necessary for the purpose for which you provided the information (for instance to purchase from our store).

We may use your personal information for the purposes of administering and improving the site, improving our services or communicating with you. The personal information you provide to us may be shared with operators to the extent necessary for them to administer and improve the website on our behalf.

We will only disclose your personal information to third parties in limited circumstances where authorised by POPIA (for instance to enable the South Africa Police Service to investigate a criminal offence).

We will use your personal information only for the purposes for which it was collected and agreed with you.  In addition, where necessary your information may be retained for legal or research purposes.

6. Retention of Data

We will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer time periods.

7. Transfer of Data

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside South Africa and choose to provide information to us, please note that we transfer the data, including Personal Data, to South Africa and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Dispak will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

8. Disclosure of Data

We may disclose personal information that we collect, or you provide:

0.1. Disclosure for Law Enforcement.

Under certain circumstances, we may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities and where we believe it is necessary to protect our rights.

0.2. Business Transaction.

If we or our subsidiaries are involved in a merger, acquisition or asset sale, your Personal Data may be transferred.

0.3. Other cases. We may disclose your information also:

0.3.1. to our subsidiaries and affiliates;

0.3.2. to contractors, service providers, and other third parties we use to support our business;

0.3.3. to fulfil the purpose for which you provide it;

0.3.4. for the purpose of including your company’s logo on our website;

0.3.5. for any other purpose disclosed by us when you provide the information;

0.3.6. with your consent in any other cases;

0.3.7. if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers, or others.

9. Security of Data

We are legally obliged to provide adequate protection for the personal information we hold and to stop unauthorized access and use of personal information. We will, on an on-going basis, continue to review our security controls and related processes to ensure that your personal information remains secure.

  • Security in contracting out activities or functions;
  • Retention and disposal of information;
  • Acceptable usage of personal information;

When we contract with third parties, we impose appropriate security, privacy and confidentiality obligations on them to ensure that personal information that we remain responsible for, is kept secure.

We will ensure that anyone to whom we pass your personal information agrees to treat your information with the same level of protection as we are obliged to.

10.Your right to access and correct personal information

We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

In certain circumstances, you have the following data protection rights:

0.1. the right to access, update or to delete the information we have on you;

0.2. the right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete;

0.3. the right to object. You have the right to object to our processing of your Personal Data;

0.4. the right of restriction. You have the right to request that we restrict the processing of your personal information;

0.5. the right to data portability. You have the right to be provided with a copy of your Personal Data in a structured, machine-readable and commonly used format;

0.6. the right to withdraw consent. You also have the right to withdraw your consent at any time where we rely on your consent to process your personal information;

Please note that we may ask you to verify your identity before responding to such requests. Please note, we may not able to provide Service without some necessary data.

You have the right to complain to The Information Regulator (Data Protection Authority) about our collection and use of your Personal Data. For more information, please contact The Information Regulator directly.

11. Your Data Protection Rights under the Protection of Personal Information Act 4 of 2013 (POPIA)

According to the Act ‘‘personal information’’ means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person.  Further to the POPI Act, Dispakalso includes the following items as personal information:

  • All addresses including residential, postal and email addresses.
  • Change of name – for which we require copies of the marriage certificate or official change of name document issued by the state department.

You have the right to request a copy of the personal information we hold about you. To do this, simply contact us at the numbers/addresses as provided on our website and specify what information you require.  We will need a copy of your ID document to confirm your identity before providing details of your personal information.

Please note that any such access request may be subject to a payment of a legally allowable fee.   

You are entitled to learn what data we collect about you, ask to delete your data and not to share it. To exercise your data protection rights, you can make certain requests and ask us:

You have the right to ask us to update, correct or delete your personal information. We would appreciate it if you would keep your personal information accurate.

Please note, if you ask us to delete or stop sharing your data, it may impact your experience with us, and you may not be able to participate in certain programs or membership services which require the usage of your personal information to function. But in no circumstances, we will discriminate against you for exercising your rights.

Your data protection rights, described above, are covered by the POPIA, short for the Protection of Private Information Act. To find out more, visit the official Legislative Information website https://www.justice.gov.za/inforeg/index.html . The POPIA took effect on 01/07/2021.

12. Service Providers

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), provide Service on our behalf, perform Service-related services or assist us in analysing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

13. Analytics

We may use third-party Service Providers to monitor and analyse the use of our Service.

This website uses Google Analytics, a web analytics service provided by Google, Inc. (‘Google’). Google Analytics uses cookies (text files placed on your computer) to help the website operators analyse how users use the site. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.

You may visit the website without providing any personal information. The website servers will in such instances collect the IP address used by the data subject to access the website, but not the e-mail address or any other personal identifiable information. The information on IP addresses is aggregated to measure the number of visits, the average time spent at the website, pages viewed, etc. We analyse non­identifiable traffic data to improve our services, via a third (3rd) party programme, namely Google Analytics.

Dispak may collect, hold, and use statistical information about website visits to help us improve the website. Such information includes:

  • Your IP address;
  • The search terms you used;
  • The pages accessed on our website and the links visitors clicked on
  • The date and time you visited the website;
  • The referring website (if any) through which you clicked through to the Dispak’s website; and
  • The type of web browser you use (eg Internet Explorer, Mozilla or Firefox).

The traffic data is aggregated and is not personally identifiable. Our website analysis will also respect any “do not track” setting you might have set on your web browser.

14. CI/CD tools

We may use third-party Service Providers to automate the development process of our Service.

15. Behavioural Remarketing

We may use remarketing services to advertise on third party websites to you after you visited our Service. We and our third-party vendors use cookies to inform, optimise and serve ads based on your past visits to our Service.

16. Payments

We may provide paid products and/or services within Service. In that case, we use third-party services for payment processing (e.g., payment processors).

We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

17. Links to Other Sites

Our Service may contain links to other sites that are not operated by us. If you click a third-party link, you will be directed to that third party’s site. We strongly advise you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.

18. Children’s Privacy

Our Services are not intended for use by children under the age of 18 (“Child” or “Children”).

We do not knowingly collect personally identifiable information from Children under 18. If you become aware that a Child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from Children without verification of parental consent, we take steps to remove that information from our servers.

19. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and update “effective date” at the top of this Privacy Policy.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
